What Makes a Good Registered Agent for Mississippi Businesses

Mississippi publishes your registered agent's name and street address in a free business search. That listing is public. It is the main fact strangers can find about your company. Act as your own agent and the address they find is your home. Appoint a commercial agent and their office fills that slot instead.

Naming an agent is a promise you make about someone else. Section 79-35-5 treats the filing as your affirmation that you notified the agent, gave them a forwarding address, and got their consent. A noncommercial agent also gives a name, an address and an email address. A commercial one is named by name alone. The state already holds the rest.

Mississippi also keeps a public list of commercial registered agents. Naming one off that list is enough. If someone is named without consenting, section 79-35-14(b) says they are not your agent at all. They owe you no duties. They may file a notice of nonacceptance to come off the record. Service on them still counts as service on you. That is the sting.

What the chapter does not do is set hours. Section 79-35-14(a) opens with the words the only duties. Then it lists four. A desk staffed from nine to five is not one of them. Read the list. It is short on purpose.

How to Choose a Registered Agent in Mississippi
